Public consultation concerning the mutual evaluation under the Services Directive
On 7 July, the EFTA Surveillance Authority launched a public consultation in the context of the "mutual evaluation process" foreseen by the Services Directive. Its objective is to receive feedback from consumers, businesses and any other interested party as to its assessment of national measures of the EFTA/EEA States implementing the Directive, as well as other existing national provisions applicable in the area of services.
The Authority would welcome all input as regards national measures that stakeholders consider to be in conflict with the rules of the Directive. In this regard, the summaries of the information provided by the EFTA/EEA States can serve as a useful starting point. However, stakeholders should feel free to bring up any other relevant issues that have not been included in these summaries.
It should be clear however that not all national implementing measures or existing national provisions are the object of this consultation. Only certain types of measures relating to requirements imposed either on the establishment of service providers or on the cross-border provision of their services form the object of this consultation. For more explanations, please see the attached consultation documents.
Any citizen, business, organisation or public authority may respond to the public consultation. The closing date for the consultation is 20 September 2010.
In order to respond to the consultation, please use the attached questionnaire and return it to services@eftasurv.int.
At the end of the public consultation, the Authority will publish the received contributions on its website. Information submitted to the Authority in response to the public consultation will be stored by the Authority and subject to its general rules on transparency. If a contributor wishes to be anonymous, please indicate this in the text of the email in which the contribution is submitted.
The European Commission has drafted a background document to its public consultation under the Services Directive. This document also provides useful background information to the public consultation carried out by the Authority:
Please note that this public consultation concerns the EFTA/EEA States, i.e. Iceland, Liechtenstein and Norway. In order to respond to the EU public consultation on the Services Directive, please follow the procedure outlined by the European Commission on http://ec.europa.eu/internal_market/consultations/2010/services_directive_en.htm.
