Antitrust : EFTA Surveillance Authority adopts Guidelines on Vertical Restraints



The EFTA Surveillance Authority adopted on 15 December 2010 new Guidelines on Vertical Restraints.

The Guidelines set out the principles for the assessment of vertical agreements under Article 53 of the EEA Agreement. The Guidelines consist of several sections.

  • Section II describes vertical agreements which generally fall outside Article 53(1);
  • Section III clarifies the conditions for the application of the Block Exemption Regulation;
  • Section IV describes the principles concerning the withdrawal of the block exemption and the disapplication of the Block Exemption Regulation;
  • Section V provides guidance on how to define the relevant market and calculate market shares; and
  • Section VI describes the general framework of analysis and the enforcement policy of the EFTA Surveillance Authority in individual cases concerning vertical agreements.

The new Guidelines complement the guidance already issued by the Authority in other notices and are without prejudice to the possible parallel application of Article 54 of the EEA Agreement to vertical agreements.
