Competition: Color Line decision published



Today, the EFTA Surveillance Authority has published its Color Line decision and a summary thereof on its website.

The decision was adopted on 14 December 2011 and concerns Color Line's short haul passenger ferry services with tax-free sales between Sandefjord in Norway and Strömstad in Sweden.

In the decision, the Authority found that Color Line's long-term exclusive harbour agreement concluded with the Municipality of Strömstad in Sweden infringed the EEA competition rules from January 1994 until December 2005. The Authority imposed a fine of EUR 18.811 million on Color Line for the infringement (see PR(11)78).

Color Line has decided not to challenge the decision before the EFTA Court and paid the fine on 14 March 2012.

Fines paid to the Authority in competition cases are disbursed to the three EEA EFTA States within 30 days in proportion to their contributions to the Authority's budget. This means that 89% of the fine is disbursed to Norway, 9% to Iceland and 2% to Liechtenstein.
