PR(07)64: The EFTA Surveillance Authority adopts revised Leniency Notice to encourage companies to report cartels


The EFTA Surveillance Authority has today adopted a revised Notice on Immunity from fines and reduction of fines in cartel cases (the revised Leniency Notice)corresponding to a European Commission Notice published on page 17 in the Official Journal C 298 of  8 December 2006.

The revised Leniency notice will strengthen the Authority’s leniency programme through increased rewards, protection and guidance for companies that provide information on a cartel. The Notice clarifies the information an applicant needs to provide to the EFTA Surveillance Authority to benefit from immunity. In addition, it introduces a discretionary marker system for immunity applicants, which allows for the acceptance of an application on the basis of limited information. It also clarifies the conditions for immunity and reduction of fines and introduces a procedure to protect corporate statements made by companies under the Leniency Notice from being made available to claimants in civil damage proceedings.

The Notice will enter into force when it is published in the Official Journal of the European Union and the EEA Supplement thereto.
