Internal Market: Extension of deadline – Posten Norge AS' request for exemption from public procurement rules

Additional information is needed before the EFTA Surveillance Authority can adopt a decision on Posten Norge AS' request for an exemption from public procurement rules for certain logistic services. The Authority has therefore extended its deadline for the conclusion of the administrative procedure until 24 July 2015.

On 23 March 2015, the Authority received a request for exemption of the application of Directive 2004/17/EC, which coordinates procurement procedures in the water, energy, transport and postal services sectors. The Directive aims at ensuring that economic operators fully enjoy fundamental freedoms in the competition for public procurement contracts.

According to Article 30(6) of Directive 2004/17/EC, the Authority is allowed a period of three months to take a decision on this request, commencing on the first working day following receipt of the request. The initial period was to expire on 24 June 2015.

Given that the Authority considered that additional information is needed in order to make a proper assessment of the request, it sent a request for information to Posten Norge AS on 6 May 2015. Hence, in compliance with the provisions laid down in the second sentence of Article 30(6) of Directive 2004/17/EC, the period allowed to the Authority to take a decision on this request is extended by one month. The final period for the Authority to take a decision therefore expires on 24 July 2015.
