Internal Market: Posten Norge AS requests exemption from public procurement rules for certain logistic services

On 23 March 2015, the EFTA Surveillance Authority received a request for exemption of the application of Directive 2004/17/EC, which coordinates procurement procedures in the water, energy, transport and postal services sectors. The Directive aims at ensuring that economic operators fully enjoy fundamental freedoms in the competition for public procurement contracts.

This request, made by Posten Norge AS pursuant to Article 30 (5) of Directive 2004/17/EC, concerns the provision of various logistic services in the postal sector in Norway. The request covers the following services: parcel and goods (B2C), parcels national (B2B), parcels international – outbound (B2B), national express “Day 1”/in-night, international express – inbound and outbound, groupage goods/general cargo and part load. Article 30 of Directive 2004/17/EC provides that the Directive is not applicable when the activity in question is directly exposed to competition on markets to which access is not restricted. These conditions are evaluated solely for the purposes of the Directive and are without prejudice to the application of competition rules.

The EFTA Surveillance Authority is allowed a period of three months to take a decision on this request, commencing on the first working day following receipt of the request: 24 March 2015. The period therefore expires on 24 June 2015 but can be extended by a maximum of three months in duly justified cases, in particular if the information provided in the request or its annexes is incomplete or inexact.
