Internal Market: Parts of the Norwegian oil and gas sector are exempt from the rules on public procurement

The EFTA Surveillance Authority has decided to exempt the exploration and the extraction of crude oil and natural gas on the Norwegian Continental Shelf from the EEA rules on public procurement in the utilities sector laid down in Directive 2004/17/EC. 

The effect of the decision is that public authorities, public undertakings or entities operating on the basis of special or exclusive rights in these sectors are not subject to the detailed procedural rules set out in Directive 2004/17. 

Activities covered by the Directive may be exempted from its scope upon application by the State or the industry, provided that access to the market is unrestricted and that the activity concerned is directly exposed to competition. Based on a thorough assessment, the Authority has concluded that both these conditions are fulfilled as regards the exploration and the extraction of crude oil and natural gas on the Norwegian Continental Shelf. The Authority has, therefore, taken the decision that these activities are exempted from the scope of application of the Directive.
