PR(09)46: Norway fails to incorporate Community regulation concerning the funding of the European Maritime Safety Agency


The EFTA Surveillance Authority has decided to deliver reasoned opinion to Norway for failure to incorporate Regulation (EC) No 1891/2006 on multiannual funding for the action of the European Maritime Safety Agency.[1]

According to Article 7 of the EEA Agreement, Norway is required to ensure that all EU Regulations that have been taken into the EEA Agreement shall become part of the national legal order, irrespective of their content. This has not been done with the regulation in question, which should have been incorporated by 9 June 2007.

Delivering a reasoned opinion is the second stage in infringement proceedings. The EFTA Surveillance Authority may bring the matter before the EFTA Court if Norway fails to take satisfactory measures within three months of receiving the reasoned opinions.
