ESA: The financial markets and Covid-19

Today, on 16 March 2020, ESA has adopted a decision on the notification threshold for disclosure of net short positions.

The decision, pursuant to Article 28 of Regulation 236/2012, requires natural or legal persons who have a net short position in a company admitted on a regulated market in the EEA EFTA States to notify the relevant competent authority where the position reaches or exceeds 0.1 percent of the issued share capital of the company concerned.

ESMA adopted an equivalent decision applicable to EU markets which also entered into force today. The decision, which is effective immediately, follows the adverse effects on EEA financial markets caused by the Covid-19 pandemic.
