PR(08)47: Temporary import and use of foreign-registered rental cars in Norway


The EFTA Surveillance Authority today delivered a reasoned opinion to Norway regarding the Norwegian legislation and practice on the temporary import and use of foreign-registered rental cars.

Under the current legislation and practice, the possibility for persons considered to be resident in Norway to enter and use in Norway a foreign-registered rental car is subject to strict conditions and limitations.One consequence of this is that persons who are permanently living in Norway, as well as persons permamently or temporarily living abroad, but who are still registered in the Norwegian Population Register, may not be allowed to use a foreign-registered rental car in Norway, not even for short stays or visits.     

In view of the Authority, these conditions amount to a restriction on the free movement of services laid down in Article 36 of the EEA Agreement, which cannot be justified by general interest.

Delivery of a reasoned opinion is the second stage in infringement proceedings. The EFTA  Surveillance Authority may bring the matter before the EFTA Court if Norway fails to take the measures necessary to comply within three months of receiving the reasoned opinion.
