PR(08)10: The EFTA Surveillance Authority brings Iceland before the EFTA Court for failing to incorporate rules relating to detergents


The EFTA Surveillance Authority today decided to bring before the EFTA Court the matter of Iceland’s failure to incorporate Regulation (EC) No 648/2004on detergents.

Regulation (EC) No 648/2004 establishes rules designed to achieve the free movement of detergents and surfactants for detergents in the internal market while, at the same time, ensuring a high degree of protection of the environment and human health.

According to Article 7 of the EEA Agreement, regulations that are incorporated into the Agreement shall thereafter "as such" be made part of the internal legal order of the EFTA States.Iceland should have incorporated the Regulation no later than 3 December 2005.

In the Internal Market Scoreboard published last week the Authority informed that the number of infringement cases against Iceland due to non-transposition of regulations has increased sharply. This is, however, the first case of its kind that is referred to the Court.
