PR(08)41: Iceland fails to incorporate rules relating to harmonisation of technical requirements and administrative procedures in the field of civil aviation

The EFTA Surveillance Authority has decided to deliver two reasoned opinions to Iceland for failure to incorporate the following Regulations:

  • Regulation (EC) No 1899/2006 of the European Parliament and of the Council of 12 December 2006 amending Council Regulation (EEC) No 3922/91 on the harmonisation of technical requirements and administrative procedures in the field of civil aviation;
  • Regulation (EC) No 1900/2006 of the European Parliament and of the Council of 12 December 2006 amending Council Regulation (EEC) No 3922/91 on the harmonisation of technical requirements and administrative procedures in the field of civil aviation.

The European regulatory framework for common safety standards for civil aviation is laid down in Regulation (EEC) 3922/91. Previously, however, a set of harmonised rules for commercial transportation by air, including flight and duty time limitations and rest periods, was governed by the the rules of the Joint Aviation Authorities (JAA). Regulation (EC) 1899/2006 incorporates those rules into Community law by adding a new Annex III to Regulation (EEC) 3922/91.

Regulation (EC) 1900/2006 amends the procedures according to which Member States may apply for derogations from the technical standards stipulated in Regulation (EEC) 3922/91.

Both Regulations should have been incorporated by Iceland by 29 September 2007.

The purpose of the Authority's reasoned opinion is to give the State in question a last chance to take corrective measures before the Authority decides whether to bring the matter before the EFTA Court. Iceland has been given three months to take the measures necessary to comply with the reasoned opinions.
