PR(96)01: EFTA Surveillance Authority clears a co-operation between ferrosilicon producers


The EFTA Surveillance Authority has taken the view that the distribution arrangement between the FESIL Group and Finnfjord Smelteverk AS, both active in the production of ferrosilicon in Norway, is justified under the EEA competition rules.

Through this arrangement, Finnfjord's ferrosilicon production is sold through FESIL on a non-exclusive basis. Although FESIL is a substantial supplier of ferrosilicon on the European markets, it faces a number of relatively large and financially strong competitors wihtin the EEA and significant imports from inter alia Central and Eastern European countries, the CIS, Brazil and China.

A Notice was published in the Official Journal on 18 January 1996 (OJ C 13/08), in which there was a brief description of the case and interested parties were invited to submit their comments. No such comments were received by the Authority.

On the basis of the Authority's examination of the case, taking into account the seemingly competitive international market for ferrosilicon and the non-exclusive nature of the distribution arrangement, an administrative letter ("comfort letter") was sent today to the concerned parties indicating that the Authority will not take any further action in the case and that the file will be closed.
