PR(98)16: The EFTA Surveillance Authority requests Iceland and Norway to comply with EEA rules

During the month of September 1998, the EFTA Surveillance Authority sent two Reasoned Opinions to Iceland and two to Norway for failing to comply with EEA rules.

The Reasoned Opinions were issued pursuant to the first paragraph of Article 31 of the Agreement between the EFTA States on the Establishment of a Surveillance Authority and a Court of Justice, and after having given the concerned Governments the opportunity to submit its observations.  The purpose of a Reasoned Opinion is to give the States in question a last chance to take corrective measures before the Authority decides to bring the matter before the EFTA Court.

Iceland: Failure to notify implementation of the Act referred to in the first indent of point 55a of Annex XIII to the EEA Agreement - 1996  Amendment to Vessels Carrying Dangerous Goods Directive (96/39/EC), and of the Act referred to in the second indent of point 55a of Annex XIII to the EEA Agreement - 1997 Amendment to Vessels Carrying Dangerous Goods Directive (97/34/EC).

Norway: Failure to notify implementation of the same Acts.

The objective of the Directive which is being amended, the Vessels Carrying Dangerous Goods Directive (93/75/EEC), is to reduce the risk and consequences of serious accidents involving dangerous or polluting goods carried by sea.  The purpose of the 1996 Amending Directive is to update references to relevant International Maritime Organization (IMO) Conventions and Codes, and that of the 1997 Amending Directive to update references to the International Maritime Dangerous Goods (IMDG) Code of the International Maritime Organization (IMO).

Iceland and Norway were to bring into force the necessary national measures to ensure compliance with the Directives, and to notify the Authority forthwith thereof, no later than 19 June 1997 and 1 March 1998, respectively.  The Authority has not yet received any communication from Iceland and Norway indicating that such measures have been taken.
