PR(00)04: The EFTA Surveillance Authority requests Liechtenstein to comply with EEA rules on Company Law


Liechtenstein had the obligation to bring into force the necessary measures to ensure compliance with six directives in the field of Company law, and inform the EFTA Surveillance Authority thereof, no later than 1 May 1998.

Having received information from Liechtenstein on national measures considered to ensure partial compliance with the directives, the Authority concluded that the notified measures did not ensure compliance with several provisions of the following directives:

·        First Company Law Directive (68/151/EEC)
·        Second Company Law Directive (77/91/EEC)
·        Directive amending the Second Company Law Directive
·        Third Company Law Directive (78/855/EEC)
·        Eleventh Company Law Directive (89/666/EEC)
·        Twelfth Company Law Directive (89/667/EEC) 

Therefore, in February 2000, the Authority sent six reasoned opinions to Liechtenstein for failure to comply with EEA rules in the field of basic company law and requested Liechtenstein to comply with the opinions within two months.  If that time passes without compliance the Authority may bring the matter before the EFTA Court.
