State aid: Public grant to Bømlabadet Bygg AS approved



The grant of NOK 12.3 million for the construction of a new aqua park on the island of Bømlo in the county of Hordaland, in Norway, does not fall within the scope of the prohibition of state aid in the EEA-agreement, according to a decision taken by the EFTA Surveillance Authority today.

The grant is to be provided by the Municipality of Bømlo to Bømlabadet Bygg AS, the company responsible for the development of the aqua park. 

To obtain legal certainty as to whether the grant is in accordance with the EEA-rules, the Norwegian Authorities notified the municipality's plans to the Authority. A complete notification was received by the Authority on 1 November 2012.

The public support does not fall within the scope of the prohibition of state aid because it does not have an effect on trade between the EEA countries as required by the state aid rules of the EEA-agreement. The aqua land will primarily serve a local market, and the Authority considers that it will not attract guests or investments from abroad.

A public version of the decision will be published on the Authority's website, normally within a month.
