You need to enable JavaScript to run this app. ESA fer fram á að Ísland samræmi tollflokkun á pítsaosti við EES reglur Eftirlitsstofnun EFTA (ESA) hefur í dag sent Íslandi formlegt áminningarbréf þar sem farið er fram á að stjórnvöld leiðrétti ranga tollflokkun á osti með viðbættri jurtaolíu, þar sem hún hamlar frjálsu flæði vara.
Í fyrra tilkynnti ESA íslenskum stjórnvöldum að kvörtun hefði borist vegna tollflokkunar á osti með viðbættum jurtaolíum, þar með talið vöru sem þekkt er undir heitinu „pizza mix“. Kvartandi hélt því fram að Ísland hefði flokkað slíkan ost í rangan tollflokk. Afleiðingin væri sú að lagður væri 30% tollur auk 795 kr. á hvert kg við innflutning til Íslands. Ef varan væri hins vegar rétt flokkuð, félli hún undir bókun 3 við EES-samninginn og bæri þar af leiðandi engan toll.
Árið 2020 ákváðu íslensk tollyfirvöld að endurskoða tollflokkun á vörum sem innihéldu svokallaðar pítsaostblöndur. Niðurstaðan varð sú að slíkar vörur féllu undir 4. kaflatollskrárinnar sem endurspeglar sama kafla í tollskrá alþjóðatollastofnunarinnar (Harmonised System), sem er alþjóðlegt kerfi sem notað er til að flokka viðskiptaafurðir. Sá kafli nær yfir mjólkurvörur og fellur utan gildissviðs EES-samningsins og ber þar með tolla. Þessi flokkun hefur síðan verið staðfest af íslenskum dómstólum.
Í formlegu áminningarbréfi ESA kemur fram að ostur með viðbættri jurtaolíu falli undir gildissvið EES-samningsins þegar mjólkurfituinnihald er allt að 15%.
Þar með, ef ostur með viðbættri jurtaolíu hefði verið rétt flokkaður í samræmi við tollflokkun alþjóðatollastofnunarinnar og EES-samninginn, bæri ekki að leggja tolla á vörurnar.
ESA hefur því komist að þeirri niðurstöðu að með því að flokka ost með viðbættri jurtaolíu – sem fellur undir gildissvið EES-samningsins – í rangan tollflokk og leggja tolla á vöruna, hafi Ísland brotið gegn skuldbindingum sínum samkvæmt EES-samningnum.
