ESA sendte i desember 2021 et formelt åpningsbrev til Norge etter å ha mottatt en klage på praksis der kommuner tar utgangspunkt i påstått enerett for å tildele kontrakter om avfallshåndteringstjenester uten konkurranse. Dette ble etterfulgt av en grunngitt uttalelse i september 2022, samt et supplerende formelt åpningsbrev i september 2023.
Sentralt i EØS-reglene for offentlige anskaffelser er prinsippet om rettferdig konkurranse, og generelt skal kontrakter over en viss verdi legges ut på offentlig anbud. Selv om det finnes unntak fra kravet om konkurranse ved tildeling av kontrakter innen offentlig sektor, vurderte ESA at vilkårene for disse unntakene ikke var oppfylt.
