E\u00d8S-tilsynet ESA har avsluttet en klagesak som omhandlet p\u00e5st\u00e5tt ulovlig st\u00f8tte gitt av Farsund kommune til lokal eiendomsutvikling.<\/strong><\/p>\n\nESA mottok i april 2018 en klage hvor det ble hevdet at Farsund kommune hadde gitt ulovlig st\u00f8tte til Glastad Farsund AS og dets datterselskaper, Farsund Vekst AS og Nordkapp Utvikling AS, til utvikling av eiendommer. Glastad Farsund er et privateid eiendomsselskap som investerer i boliger og n\u00e6ringseiendommer i Norge.<\/p>\n\n
I 2011 inngikk Farsund kommune og Glastad Farsund fem avtaler som omhandler regulering av et samarbeid om mulig utvikling av boliger og n\u00e6ringseiendom i Nordkapp, Far\u00f8y og Ferjeveien. De aktuelle eiendommene skulle utvikles gjennom Farsund Vekst, et aksjeselskap etablert for dette form\u00e5let.<\/p>\n\n
Gjennom unders\u00f8kelser som ble \u00e5pnet i 2019<\/a> har ESA vurdert om kommunen har gitt ulovlig st\u00f8tte knyttet til utbyggingen av Nordkapp og Far\u00f8y ved \u00e5:<\/p>\n\n\n\tInng\u00e5 opsjonsavtaler for Nordkapp- og Far\u00f8yomr\u00e5dene som ikke har noen prisjusteringsmekanisme ved fremtidig pris\u00f8kning og hvor kommunen ikke kompenseres for opsjonene.<\/li>\n\t Selge en del av Nordkapp (Nordkapp 1) til under markedspris.<\/li>\n\t Selge kommuneeide aksjer i Farsund Vekst til under markedspris.<\/li>\n<\/ul>\n\nGjennom en grundig unders\u00f8kelse konkluderer ESA med at det ikke er tilstrekkelig grunnlag for \u00e5 fastsl\u00e5 at tiltakene, i statsst\u00f8tterettslig forstand, ga \u00f8konomiske fordeler til de p\u00e5st\u00e5tte st\u00f8ttemottakerne.<\/p>\n\n
ESA finner p\u00e5 denne bakgrunn at det ikke kan konkluderes med at noen av tiltakene utgj\u00f8r statsst\u00f8tte i strid med E\u00d8S-avtalen. <\/p>\n\n

Gjennom en grundig undersøkelse konkluderer ESA med at det ikke er tilstrekkelig grunnlag for å fastslå at tiltakene, i statsstøtterettslig forstand, ga økonomiske fordeler til de påståtte støttemottakerne.
ESA finner på denne bakgrunn at det ikke kan konkluderes med at noen av tiltakene utgjør statsstøtte i strid med EØS-avtalen.
