You need to enable JavaScript to run this app. Ríkisaðstoð til endurskipulagningar á Íslandsbanka samþykkt Eftirlitsstofnun EFTA (ESA) hefur í dag samþykkt ríkisaðstoð sem veitt var til endurskipulagningar á Íslandsbanka.
Með þessari endanlegu ákvörðun varðandi ríkisaðstoð til Íslandsbanka er lokið einu af veigameistu málunum sem ESA hefur haft til rannsóknar í kjölfar hruns fjármálakerfisins á Íslandi árið 2008.
“Bankinn mun áfram mæta áskorunum í því að tryggja rekstrarhæfi til frambúðar, en ég lýsi ánægju minni með þann árangur sem hefur náðst. Íslensk stjórnvöld hafa beitt sér fyrir umtalsverðum umbótum á löggjöf og reglum um fjármálastarfsemi og eftirlit með henni. Jafnframt hafa þau nú boðist til að taka á sig skuldbindingar sem ætlað er að tryggja að fjármálamarkaðir á Íslandi muni njóta góðs af vikri samkeppni”, sagði frú Oda Helen Sletnes, forseti Eftirlitsstofnunar EFTA.
Íslandsbanki var stofnaður haustið 2008 í framhaldi af hruni Glitnis banka. Innlend starfsemi Glitnis var færð til Íslandsbanka sem og að mestu innlendar eignir og skuldbindingar. Við endurreisnina veittu íslensk stjórnvöld nýja bankanum ríkisaðstoð í formi eiginfjárframlaga, lausafjárfyrirgreiðslu og ótakmarkaðrar ríkisábyrgðar á innlánum í innlendum bönkum og sparisjóðum.
Við rannsóknina hefur verið lagt mat á það hvort aðstoðin teljist samrýmanleg EES-samningnum á grundvelli b-liðar, 3. málsgreinar 61. greinar samningsins. Það ákvæði heimilar að samþykkja aðstoð til að ráða bót á alvarlegri röskun á efnahagslífi EES-ríkis. Til þess að slík aðstoð teljist samrýmanleg þarf að leggja fram áætlun um endurskipulagningu, sem þarf að sýna fram á að:
með áætluninni náist fram rekstrarhæfi til langs tíma; kostnaður við endurskipulagningu skiptist hæfilega milli eigenda bankans, bankans sjálfs og ríkisins og að ríkisaðstoðin takmarkist við það sem nauðsynlegt er; fullnægjandi ráðstafanir séu gerðar til að draga úr röskun á samkeppni. Þar sem ríkisaðstoð til Íslandsbanka var veitt áður en hún var tilkynnt ESA, ákvað stofnunin þann 15. desember 2010 að hefja formlega rannsókn á viðkomandi ráðstöfunum. Í mars 2011 lögðu íslensk stjórnvöld fram upphaflega áætlun um endurskipulagningu, en breytt áætlun var svo lögð fram í febrúar 2012.
Eftir ítarlegt mat á lokaáætlun um endurskipulagningu komst ESA í dag að þeirri niðurstöðu að ráðstafanirnar fælu í sér ríkisaðstoð sem þó væri samrýmanleg reglum EES-samningsins.
Hvað varðar endurnýjun á rekstrarhæfi bankans til frambúðar er í ákvörðun ESA lögð áhersla á að þótt bankinn og íslenskt efnahagslíf mæti ennþá áskorunum, hefur Íslandsbanki tekist á við brotalamir forvera síns. Bankinn býr nú við sterkt eiginfjárhlutfall og hefur náð árangri varðandi endurskipulagningu lána skuldsettra viðskiptavina sinna. ESA hefur einnig tekið tillit til þess að margvíslegar umbætur hafa verið gerðar á löggjöf um fjármálastarfsemi frá hruni fjármálakerfisins haustið 2008. Þessar breytingar hafa styrkt regluverk um fjármálastarfsemi á Íslandi og þar með aukið á öryggi í rekstri fjármálafyrirtækja.
Þar sem fyrrum eigendur Glitnis banka hafa glatað hlutafjáreign sinni og lánadrottnar bankans þurfa einnig að sæta miklu tapi, telur ESA að kröfu um nægjanlegt framlag eigenda og fjárfesta sé mætt og bót sé ráðin á svonefndum freistnivanda.
Íslandsbanki og íslensk stjórnvöld hafa boðist til að taka á sig ýmsar skuldbindingar sem draga úr röskun á samkeppni. Þar til tímabili endurskipulagningar lýkur er Íslandsbanka þannig óheimilt að kaupa aðrar fjármálastofnanir nema með samþykki ESA. Þá skuldbindur bankinn sig til að selja áfram eignarhluti í fyrirtækjum. Ennfremur mun bankinn veita upplýsingar á vefsíðu sinni um hvernig skipta megi um viðskiptabanka og gera skjöl þar að lútandi aðgengileg.
Við mat á áhrifum aðstoðarinnar á samkeppni á Íslandi hefur ESA átt náið samstarf við Samkeppniseftirlitið.
